| Description: | In 1981 Congress authorized the first legislation that allowed states to waive certain requirements
for long-term institutional care and still receive medicaid money for services which occurred instead of institutional care. This allowed states to provide home and community-based services to individuals who were eligible. Such “HCBS waivers” permitted states to both deinstitutionalize and divert new admissions from long-term care facilities and state hospitals. State have to assure the Department of Health and Human Services (HHS) that the per capita cost to provide waiver services would not exceed the per capita cost of providing institutional care. |
